StockLifter Assessment Terms of Service
1. About these terms
These Terms of Service (the “Terms”) govern your use of the StockLifter Assessment at https://assessment.stocklifter.com/ (the “Assessment”), operated by StockLifter of Vancouver, British Columbia, Canada (“StockLifter”, “we”, “us”). By using the Assessment you agree to these Terms. If you use it on behalf of a company or other organization, you confirm that you are authorized to accept these Terms for it, and “you” includes that organization. If you do not agree, do not use the Assessment.
2. What the Assessment does
The Assessment runs automated checks of publicly available pages of a website you submit, together with public performance and business-listing information from third-party services such as Google, and any answers you provide. It produces a readiness report with scores, findings and recommendations. You can unlock the full report after verifying your email address or signing in with Google. The Assessment is provided free of charge.
3. Eligibility and accounts
You must be at least the age of majority in your province or territory of residence (19 in British Columbia) or have the consent of a parent or guardian, and be able to form a binding contract. You must provide accurate information and only use email addresses and Google accounts that you are entitled to use. You are responsible for activity carried out through your verification codes and sign-in sessions.
4. Websites you submit
Submit only publicly accessible website addresses. By submitting a website you confirm that your request is for a legitimate purpose, such as assessing your own organization's website, a client's website with permission, or a publicly available website for general research. The Assessment respects robots.txt instructions and applies request limits, and some pages may be skipped or unavailable as a result.
Where a business owner connects Google Business Profile or Search Console, you confirm you are authorized to access that account. Connected data is used only to add owner evidence to your report and can be disconnected at any time.
5. Acceptable use
You agree not to:
- use the Assessment to harass, defame, attack or gain unauthorized access to any website, system or person;
- submit internal, private or credential-protected addresses, or attempt to make the Assessment reach private networks;
- overload, interfere with, probe or bypass the Assessment's rate limits, verification or security measures;
- use automated tools to scrape, mass-submit or resell the Assessment or its reports;
- include confidential information, passwords or sensitive personal information in your submissions or answers;
- use the Assessment in breach of any applicable law, including Canada's Anti-Spam Legislation (CASL) and privacy laws.
We may suspend, limit or block access where we reasonably believe these Terms have been breached or to protect the Assessment and its users.
6. Reports are informational only
Reports are generated automatically from a limited sample of public pages at a point in time. Scores are observed-signal indicators, not a certification, audit or guarantee. Checks that cannot be measured are shown as unknown or not assessed. Reports do not constitute legal, accessibility, regulatory, securities, financial, investment or professional advice, and they do not confirm compliance with any law or standard. Any sample or demonstration content is illustrative only. You are responsible for decisions you make based on a report, and you should consult a qualified professional where appropriate.
7. Intellectual property
StockLifter and its licensors own the Assessment, including its software, methodology, scoring criteria, design, logos and trademarks. Subject to these Terms, you may download, use and share reports generated for you for your internal business purposes. You may not copy, modify, reverse engineer or commercially redistribute the Assessment or its methodology. Content from third-party websites and services (such as Google Maps data) remains the property of its owners and is subject to their terms.
You keep any rights you have in information you submit. You grant us a non-exclusive licence to use it to provide, secure and improve the Assessment, as described in our Privacy Policy.
8. Third-party services
The Assessment relies on third-party services, including Google (PageSpeed Insights, Chrome UX Report, Places, Business Profile, Search Console and Google sign-in), our hosting providers and our email delivery provider. Your use of Google features is also subject to Google's terms, including the Google Maps Terms of Service and Google Privacy Policy. We are not responsible for third-party services, their availability or the accuracy of their data.
9. Privacy and communications
Our Privacy Policy explains how we handle personal information under British Columbia's Personal Information Protection Act and, where applicable, the federal Personal Information Protection and Electronic Documents Act. Verification codes and report-access emails are transactional messages. We will send marketing messages only with your consent, in accordance with CASL, and every marketing message will include a way to unsubscribe. Receiving your report never depends on agreeing to marketing.
10. Availability and changes to the service
We may change, suspend or discontinue any part of the Assessment at any time. Scans may be interrupted, for example if you close your browser, and you may need to run them again. Reports are not stored for later retrieval, so please download any report you want to keep.
11. Disclaimer of warranties
To the fullest extent permitted by law, the Assessment and reports are provided “as is” and “as available”, without warranties or conditions of any kind, whether express, implied or statutory, including implied warranties or conditions of merchantability, quality, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Assessment will be uninterrupted, error-free or secure, or that reports will be complete or accurate.
12. Limitation of liability
To the fullest extent permitted by law, StockLifter and its directors, officers, employees and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, goodwill or business opportunity, arising from or related to the Assessment or any report, even if advised of the possibility of such damages. Our total liability for any claim relating to the Assessment is limited to one hundred Canadian dollars (CAD $100). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including rights you may have as a consumer under British Columbia's Business Practices and Consumer Protection Act.
13. Indemnity
To the extent permitted by law, you agree to indemnify StockLifter against claims, losses and reasonable costs, including legal fees, arising from your breach of these Terms, your misuse of the Assessment, or your violation of any law or third-party right.
14. Governing law and disputes
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, without regard to conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Before starting formal proceedings, please contact us so we can try to resolve the dispute informally. Subject to any mandatory rights you have under the laws where you live, you and we agree to the exclusive jurisdiction of the courts of British Columbia, sitting in Vancouver, including the Civil Resolution Tribunal where it has jurisdiction.
15. General
If any provision of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or sale of our business. These Terms and our Privacy Policy are the entire agreement between you and us regarding the Assessment. If these Terms are translated, the English version prevails.
16. Changes to these terms
We may update these Terms by posting a revised version on this page and changing the effective date. Changes apply from the date they are posted. Continuing to use the Assessment after that date means you accept the updated Terms.
